1. PURPOSE OF THIS PRIVACY POLICY
OnTheList Limited (referred to in this Privacy Policy as ”OnTheList”, ”we”, ”us” or ”our”) respects your privacy and is committed to protecting your personal data. This Privacy Policy will inform you as to how we look after your personal data when you visit us at th.onthelist-store.com, regardless of where you visit them from, or use the OnTheList mobile application for iOS or Android (the ”App”) and tell you about your privacy rights and how the law protects you.
This Privacy Policy aims to give you information on how we collect and process your personal data through your use of the Websites or App, including any data you may provide through the Websites or App when you sign up to our newsletter, purchase any products or services and/ or take part in a competition.
The Websites and the App are not intended for children and we do not knowingly collect data relating to children.
It is important that you read this Privacy Policy together with any other Privacy Policy or fair processing policy we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This Privacy Policy supplements other notices and Privacy Policies and is not intended to override them.

OnTheList is a ”data controller” of your personal data.
In simple terms, this means that we (i) ”control” your personal data, including making sure that it is kept secure; and (ii) make certain decisions on how to use and protect your personal data, but only to the extent that we have informed you about the use or as otherwise permitted by law.

1.3. CHANGES TO THIS PRIVACY POLICY AND PERSONAL DATA
This Privacy Policy is regularly reviewed and was last updated on 25th October 2023. We may amend or update our Privacy Policy from time to time. For this purpose, we will provide you notice of amendments to this Privacy Policy and update the ”last updated” date above.
It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.
1.4. THIRD-PARTY LINKS
The Websites and the App may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. 2. THE DATA WE COLLECT ABOUT YOU
The types of personal data we collect, use and store about you will depend on the services you have requested from us and/or the nature of your interaction with us. When using our Websites or the App, we collect and process the following types of personal data:
· your first name, last name, username or similar identifier, date of birth, nationality and gender (”Identity Data”);
· your billing address, delivery address, email address and telephone numbers (”Contact Data”);
· your bank account and payment card details (”Financial Data”);

We do not collect any special categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offenses.
3. HOW WE COLLECT YOUR DATA
3.1 DIRECT INTERACTIONS
We collect Identity Data, Contact Data and Financial Data about you that you provide to us by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:
· apply for our products or services;
· register on our Websites or the App;
· subscribe to our newsletter;
· request other marketing material to be sent to you;
· enter a competition, promotion or survey; or
· give us feedback or contact us in any way or form.
3.2. AUTOMATED TECHNOLOGIES AND INTERACTIONS
As you interact with our Websites or the App, we will automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies and other similar technologies.

We are also working closely with third parties (including, for example, analytics providers and other third party providers of services).
We will receive personal data about you from such third parties as set out below:-
· Technical Data and Usage Data from analytics providers such as Google, based inside and outside the EEA;
· Contact Data, Financial Data and Transaction Data from providers of payment services such as Stripe, eWay and Shopify, based inside and outside the EEA;
· Contact Data from delivery services such as Kerry Express, DHL, SF Express, Yamato Logistics, ARAMEX, On Time and CN Logistics, based inside and outside the EEA;
· Contact Data from mailing list providers such as Mailchimp, Mandrill and Twilio; and
· Identity Data and Contact Data from publicly available sources such as the Companies Registry of Thailand, based inside and outside the EEA
4. HOW WE USE YOUR PERSONAL DATA
4.1 DATA USAGE
We are committed to only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:
· Where we need to perform the contract we are about to enter into or have entered into with you (”Performance of Contract”).
· Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests (”Legitimate Interests”).
· Where we need to comply with a legal obligation (”Legal Obligations”).
We plan to use your personal data for the following purposes, and pursuant to the corresponding legal bases. We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the
processing for the new purpose is compatible with the original purpose, please feel free to contact us any time.
Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.
4.2. MARKETING AND PROMOTIONAL OFFERS
We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising.
We may use your Identity Data, Contact Data, Technical Data, Usage Data and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you.
You will receive marketing emails and newsletters from us if you have requested information from us or purchased products or services from us, or if you provided us with your details when you entered a competition or registered for a promotion and, in each case, you have expressly consented to receiving such marketing emails and newsletters.

You can ask us or third parties to stop sending you marketing messages at any time by:

Where you opt-out of receiving these marketing messages or newsletters, this will not apply to personal data provided to us as a result of a product or service purchase, product or service experience or other transactions (which we will continue to process in order to perform a contract with you or as a result of our regulatory or legal obligations).
5. DISCLOSURES OF YOUR PERSONAL DATA
We may share your personal data with the following parties for the purposes set out in the table above:-
· External Third Parties as set out in Clause 11 (Definitions) below; and
· third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Privacy Policy.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
6. INTERNATIONAL TRANSFERS
We may disclose or transfer your Personal Data to other countries, a third party or a server located overseas where such destination country may or may not have the same data protection standards. Provided that, On the list will proceed with procedures and measures to ensure that your Personal Data will be securely transferred, and that the person who receives your Personal Data has in place appropriate data protection standards or other derogations as permitted by laws. On the list will request your consent if it is required by applicable laws for transferring Personal Data to overseas.

· Where we use providers based in the US, we may transfer data to them if they are part of the Privacy Shield which requires them to provide similar protection to personal data shared between Europe and the US. For further details, see European Commission: EU-US Privacy Shield.

7. DATA SECURITY
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
8. DATA RETENTION
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.
9. YOUR LEGAL RIGHTS IN THAILAND
We are aware of your personal rights which are under protection of PDPA in which you are entitled to exercise those rights at any time by sending a request to us. We will strictly proceed in accordance with your request pertaining to the rights of Data Subject under PDPA as the following
Rights to Withdraw Consent
You have the rights, at any time, to withdraw the consent given to On the list for collection, use and/or disclosure of your Personal data except that such rights are restricted under applicable laws or contract which benefits you.
Rights to Access Information
You have the rights to request for accessing and receiving a copy of your Personal Data which is in possession of On the list or request us to disclose acquisition of such Personal Data for which you have not given your consent.
Rights to Object Collection, Use or Disclosure of Personal Data
You have the rights to object collection, use or disclosure of your Personal Data as follows:
· For Personal Data collected under the necessity for the performance of a task carried out in the public interest by On the list or the necessity for legitimate interest of us or other persons, provided that, We may reject your rights in case we are able to justify
greater importance of its legitimate interest, or establishing legal claim, complying with the law, or exercising or defending legal claims;
· For the collection, use or disclosure of Personal Data for direct marketing purpose
You have the rights to request us to amend your Personal Data so that it is up-to-date, correct and not misleading.
9.1. NO FEE USUALLY REQUIRED
You will not have to pay a fee to access your personal data (or to exercise any of the other rights) in accordance with Clause 9.1 above. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
9.2. INFORMATION REQUIRED
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data in accordance with Clause 9.1 (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
9.3. TIME LIMIT TO RESPOND
We try to respond to all legitimate requests made in accordance with Clause 9.1 within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
9.4 LANGUAGE
This Privacy Policy is drafted in English and Thai. If there is a conflict between the English and the Thai version of this Privacy Policy, the English version shall prevail to the maximum extent permitted by law.
10. DEFINITIONS
In this Privacy Policy, the following expressions shall have the following meanings except where the context otherwise required:-
”External Third Parties”shall mean (a) service providers who provide IT and system administration services; (b) professional advisors including lawyers, bankers, auditors and insurers based in Thailand who provide consultancy, banking, legal, insurance and accounting services; and (c) the Inland Revenue Department, regulators and other authorities based in Thailand who require reporting of processing activities in certain circumstances.
”Legitimate Interests”shall mean the interest of our business in conducting and managing our business to enable us to give you the best service/ product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by contacting us.
”Legal Obligations”shall mean processing your personal data where it is necessary for compliance with a legal obligation that we are subject to.
”Performance of Contract”shall mean processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

เราทราบดีถึงสิทธิตามกฎหมายของคุณ ซึ่งอยู่ภายใต้ความคุ้มครองของ PDPA และระบุว่าคุณสามารถใช้สิทธิเหล่านี้ได้ทุกเมื่อโดยส่งคำขอมาที่เรา เราจะดำเนินการตามคำขอของคุณที่เกี่ยวกับสิทธิการเป็นเจ้าของข้อมูลภายใต้ PDPA ดังต่อไปนี้อย่างเคร่งครัด

สิทธิในการคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล
คุณมีสิทธิในการคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลในกรณีต่อไปนี้

นโยบายความเป็นส่วนตัวฉบับนี้ทำขึ้นเป็นภาษาอังกฤษและภาษาไทย หากนโยบายความเป็นส่วนตัวฉบับภาษาอังกฤษและภาษาไทยมีข้อขัดแย้งกัน ให้ยึดฉบับภาษาอังกฤษเป็นสำคัญตามขอบเขตที่กฎหมายอนุญาต
10. คำจำกัดความ
ในนโยบายความเป็นส่วนตัวฉบับนี้ คำต่อไปนี้มีความหมายดังที่ระบุ เว้นแต่บริบทจะกำหนดไว้เป็นอย่างอื่น:
“บุคคลภายนอก” หมายถึง (ก) ผู้ให้บริการที่ให้บริการด้านไอทีและการดูแลระบบ (ข) ที่ปรึกษามืออาชีพ ได้แก่ ทนายความ นักการธนาคาร ผู้ตรวจสอบภายใน และผู้รับประกันที่ดำเนินงานในประเทศไทยและให้บริการด้านการให้คำปรึกษา การธนาคาร กฎหมาย ประกัน และการบัญชี และ (ค) กรมสรรพากร หน่วยงานกำกับดูแล และหน่วยงานอื่น ๆ ที่ดำเนินงานในประเทศไทยที่กำหนดให้มีการรายงานกิจกรรมการประมวลผลในบางกรณี
“ผลประโยชน์อันชอบด้วยกฎหมาย” หมายถึง ผลประโยชน์ของธุรกิจของเราในการดำเนินธุรกิจและจัดการธุรกิจเพื่อให้เราสามารถส่งมอบบริการ/สินค้าที่ดีที่สุด รวมทั้งประสบการณ์ที่ดีและปลอดภัยที่สุดให้กับคุณได้ เราดูแลให้มั่นใจว่าเราคำนึงถึงและรักษาสมดุลของผลกระทบที่อาจเกิดขึ้นกับคุณ (ทั้งแง่บวกและแง่ลบ) และสิทธิของคุณก่อนจะประมวลผลข้อมูลส่วนบุคคลของคุณเพื่อผลประโยชน์อันชอบด้วยกฎหมายของเรา เราจะไม่ใช้ข้อมูลส่วนบุคคลของคุณเพื่อทำกิจกรรมที่ผลกระทบที่เกิดกับคุณจะใหญ่หลวงกว่าผลประโยชน์ของเรา (นอกเสียจากว่าจะได้รับความยินยอมจากคุณ หรือกฎหมายกำหนดหรืออนุญาต) คุณสามารถขอรับข้อมูลเพิ่มเติมเกี่ยวกับวิธีการประเมินผลประโยชน์อันชอบด้วยกฎหมายของเราเทียบกับผลกระทบที่อาจเกิดขึ้นกับคุณจากกิจกรรมเฉพาะได้โดยการติดต่อมาที่เรา
